These Terms of Service explain the rules for using this website and the general terms that apply when you ask Ultra Carpet & Flooring about products or services. By using the website, you agree to the parts of these Terms that apply to website use. A purchase, delivery, measurement, or installation is also governed by the applicable written quote, invoice, order confirmation, installation agreement, or other written transaction document. If a specific written transaction term conflicts with these general Terms, the specific written term controls for that transaction, subject always to applicable law and any rights that cannot be waived.
1. About us
Ultra Carpet & Flooring is a flooring retailer and installation business in Mississauga, Ontario. In these Terms, “Ultra Carpet & Flooring,” “we,” “us,” and “our” refer to the business identified in the Contact section below. “You” means a visitor to the website or a customer dealing with us.
2. Using this website
You may use the website for lawful personal or business purposes related to learning about our business, contacting us, or considering our products and services. You must not:
- interfere with the website, its security, or another person’s use of it;
- introduce malicious code, attempt unauthorized access, or misuse forms or contact details;
- impersonate another person or submit information you know is false or unlawful; or
- copy, republish, or exploit website content except as allowed by these Terms or by law.
We may restrict access where reasonably necessary to protect the website, our systems, or other users. The website is not intended to create a customer account or to complete an online flooring order.
3. Product and service information
Website descriptions, photographs, colours, samples, dimensions, specifications, performance statements, prices, and availability are general information. We try to keep them accurate, but products may change, be discontinued, become unavailable, or differ from what appears on a screen. Natural materials and manufactured products may also have variations in colour, grain, texture, pattern, shade, or dye lot.
Product claims such as water resistance, durability, wear resistance, or suitability are subject to the manufacturer’s current specifications, approved uses, installation requirements, exclusions, and care instructions. Before confirming an order, review the exact product, model, colour, grade, quantity, intended room or use, and applicable manufacturer information in the written transaction documents. Website content alone is not a promise that a product is suitable for a particular property, subfloor, environment, or purpose.
4. Quote requests, quotes, and measurements
Submitting a form, asking for a quote, discussing a project, or arranging a measurement does not by itself create an order or require either party to proceed. The applicable written quote or order document will identify the products, services, scope, pricing, taxes, assumptions, and any period for which the offer remains available.
Quotes and material quantities may depend on measurements, information supplied by you, product selection, installation method, layout, cuts, pattern matching, reasonable waste allowances, and conditions visible at the time of review. Net room area and the quantity of flooring required are not always the same. If measurements, selections, instructions, or site conditions change, the scope, quantity, price, or schedule may also need to change. Any transaction change should be recorded in a revised quote, change order, or other written confirmation.
Before accepting a quote or order, please review the product selection, areas to be covered, measurements, preparation work, included and excluded services, delivery or installation scope, pricing, taxes, schedule, and each party’s responsibilities. Raise any error or uncertainty before work or ordering begins.
5. Orders and payment
The commercial terms for an order are the terms stated in the applicable written quote, invoice, order confirmation, installation agreement, and any agreed change order. Those documents govern the amount payable, payment timing, accepted payment arrangements, taxes, and any conditions that must be met before products are ordered or work is scheduled.
An order is subject to the product availability and confirmation terms stated in the applicable written documents. Any correction to a product, scope, quantity, or price must be handled in writing and in accordance with applicable law. Nothing in these Terms requires a payment, charge, or fee that is not disclosed in the applicable transaction documents or otherwise permitted by law.
6. Cancellations, changes, returns, and refunds
If you want to cancel or change an order or service, contact us as soon as possible. Whether a cancellation, change, return, exchange, refund, credit, or charge is available depends on the applicable written transaction documents, the stage of the order or work, the condition and status of the product, any disclosed supplier or manufacturer restrictions, costs already reasonably incurred, and applicable law.
If a product-specific restriction applies, including a restriction connected with an ordered, cut, altered, or specially sourced product, it should be stated in the applicable written transaction documents. These Terms do not create a blanket no-return or no-refund rule. They also do not limit any non-waivable right or remedy for goods or services that are defective, misdescribed, not supplied, or otherwise covered by applicable consumer protection law.
7. Delivery, installation, and site readiness
Delivery, removal of existing flooring, moving furniture or appliances, subfloor preparation, disposal, installation, trim work, and other project tasks are included only if they appear in the applicable written scope. The written transaction documents also define the agreed project scope and any project-specific commitments.
Before delivery or installation, you must follow the reasonable written preparation instructions for the project. Depending on the agreed scope, this may include providing safe and timely access, securing children and pets away from the work area, moving or protecting belongings identified in the instructions, ensuring required utilities are available, and arranging building access, parking, elevator bookings, permits, or approvals assigned to you in writing.
Please disclose known conditions that may affect the work, including water or moisture problems, uneven or damaged surfaces, mould, asbestos or other hazardous materials, structural concerns, concealed wiring or plumbing, prior coatings or adhesives, and building or condominium rules. We may pause work if a condition creates a safety concern, prevents proper installation, or falls outside the agreed scope.
Some conditions cannot reasonably be confirmed until existing flooring is lifted or the work area is opened. If hidden or unexpected conditions require additional preparation, materials, labour, or time, the proposed change should be described in a written change order, revised quote, or other written confirmation. Added work and related pricing should be accepted as applicable before that added work proceeds, subject to urgent safety requirements and applicable law.
When products are delivered or work is completed, please report visible shortages, damage, or concerns promptly so they can be reviewed. Doing so does not take away rights relating to a problem that was not reasonably discoverable at that time.
8. Care and maintenance
Follow the manufacturer’s current installation, environmental, cleaning, maintenance, and care instructions, together with any written instructions provided for your project. Product choice and care may need to account for moisture, temperature, sunlight, pets, furniture, footwear, cleaning products, and the intended use of the space. General website articles do not replace product-specific instructions.
9. Information and material you submit
When you submit a contact or quote request, you confirm that the information is accurate to the best of your knowledge and that you are permitted to provide it. Do not send unnecessary sensitive information through a website form. You authorize us and our service providers to process the submission as reasonably needed to receive, secure, classify, store, respond to, and manage the request, as described in our Privacy Policy.
A form submission does not guarantee product availability, acceptance of a project, a response within a particular time, or the creation of an order. Do not submit unlawful, harmful, infringing, or misleading content.
If you separately agree that we may publish a testimonial, review, photograph, or other material, you confirm that you have the right to provide it and grant us the limited permission described in that separate agreement. A contact or quote request alone does not give us permission to publish your message or project material.
10. Intellectual property
The website and its text, graphics, logos, photographs, design, and other content are owned by or licensed to Ultra Carpet & Flooring and are protected by applicable intellectual property laws. You may view and print reasonable portions for your own non-commercial use. No other right or licence is granted. Product names, logos, and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.
11. Third-party links and features
The website may contain links, maps, videos, reviews, security tools, or other features supplied by third parties. Their services, content, availability, and privacy practices are controlled by them. A link or feature does not mean that we control or guarantee the third party. Use third-party services subject to their own terms and policies.
12. Website disclaimers
The website is provided for general information and convenience. It is not a substitute for a site assessment, product specifications, manufacturer instructions, or the applicable written transaction documents. To the extent permitted by law, the website is provided “as is” and “as available,” and we do not promise that it will always be uninterrupted, secure, current, or error-free. Nothing in this section excludes a statutory right or remedy that applicable law does not allow us to exclude.
13. Limits on responsibility
To the maximum extent permitted by applicable law, we are not responsible for indirect, incidental, special, or consequential loss arising only from use of, or inability to use, the website or from reliance on general website content. Responsibility for a product sale, delivery, measurement, or installation is determined by the applicable written transaction documents and applicable law.
Nothing in these Terms excludes or limits liability for our own fraud, wilful misconduct, or any other matter that applicable law does not permit us to exclude or limit. Nothing in these Terms removes a non-waivable consumer right or remedy.
14. Responsibility for unlawful misuse
To the extent permitted by law, you agree to reimburse us for reasonable, documented losses and third-party claims arising directly from your deliberate unlawful use of the website or from material you knowingly submit without the required rights. This does not apply to the extent a loss is caused by us, and it does not limit any consumer right that cannot be waived.

Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information submitted through the website. It forms part of these Terms for website-related personal information.
16. Changes to these Terms
We may update these Terms to reflect changes to the website, our practices, or applicable requirements. The updated version will be posted on this page with a revised “Last updated” date and will apply to website use from that point forward. An update to these website Terms does not retroactively change an accepted order or installation agreement unless the parties agree in writing or applicable law requires the change.
17. Severability and no waiver
If a court or tribunal with authority finds part of these Terms invalid or unenforceable, that part will be limited or removed only to the extent necessary, and the remaining parts will continue to apply. A delay in enforcing a term is not a waiver of that term.
18. Governing law and consumer rights
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. This choice of law does not take away any mandatory protection available to you under applicable consumer law and does not require you to give up a right to make a complaint or bring a claim before a court, tribunal, or regulator that has jurisdiction.
